Statement from the City of Eagle concerning Eagle Water Co. Customer Letter

On October 21, Eagle Water Company President Robert DeShazo sent a letter to its customers that contains several incorrect statements.

  • The City’s former law firm did not advise against suing Eagle Water Company to enforce the City’s Right of First Refusal to purchase all or part of Eagle Water Company’s water system.
  • The City’s prior law firm drafted and sent the notice of default letter to Eagle Water Company stating that Eagle Water was in breach of the Right of First Refusal contained in the Intertie Agreement between Eagle Water and the City.
  • The City’s prior law firm also took action for the City to intervene in the Public Utilities Commission proceeding asking for approval of the sale of Eagle Water to SUEZ.  The City opposed the PUC approval because, among other reasons, Eagle Water was in violation of the Right of First Refusal. 
  • As noted in the City’s lawsuit, Eagle Water did not honor the City’s permanent Right of First Refusal and later claimed it never existed.
  • Eagle Water recently lost a court motion to have the City’s case against it and SUEZ dismissed; Eagle Water and DeShazo are not objective observers.  They are interested parties seeking to complete the sale of Eagle Water to SUEZ in violation of the Right of First Refusal.
